An AI tool can write a 40 page business plan in four minutes. It will read well. It will have headings, tables and confident language.
And it will often fail the two reviews that matter most to our clients: an SBA underwriter’s file review and a USCIS officer’s adjudication.
This is not about AI detection. Neither SBA nor USCIS publishes a rule that bans AI assisted writing. Plans fail because of what AI tools get wrong: invented facts, generic markets, numbers that do not agree and rules that changed after the model was trained.
Below are the eight failure points we see most often, and how to use AI without walking into them.
Why This Matters More in 2026
Two things changed this year.
SBA rules moved. SOP 50 10 8.1, effective for loans numbered from 1 October 2026, requires acquisition coverage on historical earnings, caps Limited equity sources at half the injection and requires 100 percent U.S. citizen or national ownership. A tool trained on older material may still write to the old rules.
USCIS review got more data driven. USCIS uses machine learning tools to classify evidence and cross check identifiers, and immigration practitioners report rising RFE and denial rates in several categories in 2026. A plan with internal inconsistencies is easier to spot when evidence is cross referenced at scale.
The 8 Failure Points
1. Invented Statistics and Sources
AI models produce numbers that sound right. Market size figures, growth rates and survey results appear with plausible sources attached. Some of them do not exist.
An SBA underwriter who checks one figure and finds it false stops trusting the rest. A USCIS officer who cannot verify a cited report may treat the market section as unsupported.
The fix: Every statistic needs a traceable source: a government dataset, a named industry report or your own customer data. If you cannot find it, remove it.
2. Generic Market Analysis
Matter of Ho requires a plan to be credible and specific. AI tends to write national market overviews: “The U.S. restaurant industry is worth $X billion and growing.” That tells an officer nothing about your restaurant on a specific corner in Orlando.
What passes: Named local competitors, their pricing, foot traffic or demand indicators for your trade area, and why your location wins.
3. Numbers That Disagree Across Sections
This is the single most common failure we see. The executive summary says 12 employees. The staffing table shows 9. The payroll line in the P&L supports 7.
AI tools generate sections separately and do not check them against each other. Underwriters and officers do.
| Figure | Where It Appears | Must Match |
| Total investment | Summary, Sources and Uses, capital deployment schedule | Exactly |
| Headcount | Summary, personnel plan, payroll in P&L | By year |
| Revenue | Summary, sales forecast, P&L | By year |
| Rent | Operations plan, lease, P&L | Monthly and annual |
| Loan amount | Summary, Sources and Uses, debt schedule | Exactly |
For immigration cases, the projections section is where inconsistency shows first. Our guide on E-2 visa business plan financial projections covers how to keep them aligned.
4. Outdated Rules
A model trained before 2026 may tell you green card holders qualify for SBA loans, that DSCR can rest on projections for an acquisition, or that regional center EB-5 filings are grandfathered. All three are wrong for filings made today.
The fix: Treat any regulatory statement from an AI tool as unverified until you check it against current SBA, USCIS or State Department guidance.
5. Job Creation That Does Not Hold Up
For EB-5, only direct W-2 full time jobs count in a direct investment. For E-2, jobs are key evidence against marginality. AI tools often count contractors, part timers or the investor’s own position.
EB-5 direct plans must show at least 10 qualifying full time jobs with a realistic hiring schedule. Our guide on what USCIS expects from EB-5 business plan writers explains the standard.
6. Boilerplate Language Across Applications
AI tools produce similar phrasing for similar prompts. Two restaurant E-2 plans generated from similar prompts can share whole paragraphs.
Officers review thousands of plans. Repeated language across unrelated cases looks templated, and templated plans invite closer scrutiny of everything else.
7. Missing Lender Specific Analysis
An SBA plan is not just a business description. Underwriters look for:
- Debt service coverage calculated the way the SOP requires.
- Sources and Uses with each equity source classified.
- A transition plan for acquisitions.
- A downside case.
Generic AI output rarely includes these because it does not know what the lender will test. Read why SBA business plans are not getting funded for the lender side view.

8. Projections Without Assumptions
AI can produce a five year P&L instantly. What it rarely produces is the assumption behind each line: why revenue grows 18 percent in year two, why food cost is 29 percent, why the second location opens in month 20.
Underwriters and officers read assumptions first. Numbers without them are guesses in a table. Our guide on how to build realistic financial projections for your business plan shows the method.
AI Plan Risk Matrix by Use Case
Not every use of AI carries the same risk. This matrix reflects what we see in practice.
| Use Case | Risk Level | Why |
| Brainstorming business ideas | Low | No reviewer sees it |
| Drafting a first outline | Low | Structure only |
| Internal strategic planning | Low to medium | Errors cost you, not a reviewer |
| Investor pitch narrative | Medium | Investors verify key claims |
| SBA or bank loan plan | High | Underwriters test every number |
| E-2 visa plan | High | Consular officers review for marginality and credibility |
| EB-5 direct investment plan | Very high | Matter of Ho, job counting and I-829 follow through |
How to Use AI Without Failing Review
AI is a useful tool when you keep it in the right role.
Use it for:
- Outlining sections before writing.
- Summarizing your own research notes.
- Checking grammar and readability.
- Generating questions you should answer about your business.
Do not use it for:
- Market statistics you have not verified.
- Financial projections without your own assumptions.
- Regulatory requirements.
- Final text submitted to a lender or USCIS without expert review.
Then run a consistency check. Put every key figure (investment, jobs, revenue, rent, loan amount) in one table and check that each appears identically across the plan.
What a Reviewer Sees in the First Five Minutes
Underwriters and officers form a view fast. In the first five minutes, they usually check:
- Does the executive summary match the financials?
- Is the market section specific to the location?
- Are the owners and their roles clear?
- Does the funding request add up?
- Do the projections have stated assumptions?
A plan that passes these five checks earns a careful read. A plan that fails two of them rarely recovers.
The Real Cost of a Cheap Plan
An AI plan feels free. A denial is not.
| Outcome | Typical Cost to the Applicant |
| SBA decline | Lost deposit on the deal, months of delay, possible loss of the business to another buyer |
| E-2 refusal | Refiling costs, legal fees, a refusal on record, and a business that may already be funded |
| EB-5 RFE or denial | Extended processing, legal fees, and in the worst case, lost time on capital already at risk |
Compared with those outcomes, the cost of a professionally written plan is small. Our guide on the E-2 visa business plan cost and what you should pay gives realistic numbers, and our piece on the benefits of hiring a professional business plan writing service explains what you get for them.
Frequently Asked Questions
Can I use an AI generated business plan for an SBA loan?
You can submit one, but it often fails underwriting. Common problems include invented statistics, outdated SBA rules and financials that do not agree across sections.
Does USCIS reject AI written business plans?
USCIS does not publish a rule against AI assisted plans. Plans fail because they lack the specificity and consistency Matter of Ho and E-2 standards require.
Can AI calculate my DSCR correctly?
It can do the arithmetic. It usually does not know which earnings the current SOP allows, which add backs underwriters accept or how seller notes are treated.
Is it safe to use AI to edit my business plan?
For grammar and readability, yes. For figures, rules or market data, verify every change against your source documents.
How do I know if my plan has AI errors?
Check every statistic’s source, confirm that key figures match across all sections and compare any regulatory claim with current official guidance.
